Where you are the person featuring in the Photograph(s), you represent and warrant that: (a) all of your Photograph(s) are of your own image, taken after 1st January 2006 and have not been altered in any way (b) you understand the nature of the competition and accept that your Photograph(s) will form part of it (c) you have obtained all consents (including without limitation, the consent of the person(s) who took your Photograph(s)) necessary for you to grant all rights you have granted to TMVCC in these Terms and Conditions.

9. Where you are the photographer of the Photograph(s), you represent and warrant that: (a) you are the author of the Photograph(s) which have been taken after 1st January 2006 and they have not been altered in any way (b) you understand the nature of the competition and accept that your Photograph(s) will form part of it (c) you have obtained all consents (including without limitation, the consent of the person featuring in the Photograph(s)) necessary for you to grant all rights you have granted to TMVCC in these Terms and Conditions.

10. You may not give your Photograph(s) to, or allow your Photograph(s) to be published or broadcast by any newspaper, magazine, other publication (Miss Custom Website/TMVCC), website, broadcaster, TV station, mobile phone company or any other medium or product that is available to the public now or in the future until you have appeared in the competiton final (if applicable). If your Photographs appear anywhere other than the Miss Custom website) while you are involved in the competition, Miss Custom may remove you (or the person featuring in the Photograph(s) if that person is not you) from the competition.

11. Entrants to the Promotion are the person featuring in the Photograph(s), who must: (a) be at least eighteen (18) years old.

12. Miss Custom reserves the right to request proof of any entrant's age.

In consideration of being given the opportunity for the Photograph(s) forming part of the competition, you hereby give TMVCC and its affiliated companies a worldwide, perpetual, royalty-free licence (such licence to be exclusive for 5 years from the date Miss Custom.com receives your Photograph(s) and profile information) to use and publish your Photograph(s) and all profile information in all media (including but not limited to print, terrestrial, cable and satellite television, video, internet, mobile telephone, or any other products) whether now known or hereafter invented for the purposes of promoting the Competition, Miss Custom publications, website and business, and for such other purposes that Miss Custom may determine from time to time. You also grant Miss Custom the rights to offer up your photographs as available to download on mobile telephone platforms, the internet or via other means. You also grant Miss Custom the right to sub-licence any of the rights you have granted to Miss Custom amend your Photograph(s), and to combine any of them with other images or media or download and not to have to identify the photographer of the Photograph(s) as author of the same, and for such other purposes that Miss Custom may determine from time to time.

14. You shall not without Miss Custom's prior written consent, disclose to anyone, any information about the competition, or any other matter revealed to you by Miss Custom, until at least thirty (30) days after the competition has finished.

15. You hereby agree to indemnify, and shall keep indemnified, Miss Custom from and against any and all actions, proceedings, costs, claims, damages and demands (including reasonable legal expenses) in respect of any breach or non-performance by you of any or all of the undertakings, warranties, and obligations in these Terms and Conditions.

16. Revision of Terms and Conditions: Miss Custom may amend or modify these terms and conditions at any time without notice. Users are responsible for reviewing this page from time to time to ensure compliance. Any use of the site by you after such update shall be deemed to constitute acceptance by you of such amendments and modifications.

17. Jurisdiction: This agreement shall be governed, construed and enforced in accordance with English law. If any provision of this agreement shall be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from this Agreement and shall not affect the validity and enforceability of any remaining provisions.

Important information regarding prizes

1. Regarding the MGF Sports Car, the winner must be in possession of a full UK driving license and will be responsible for providing her own fully comprehensive insurance. The MGF sports car will be loaned to the winner for 1 year for her personal and professional use from the date of being crowned Miss Custom europe 2007. The vehicle must be returned to 'HireLimos' in a clean and respectable condition at the end of the year's loan. The winner agrees to be financially responsible for any damage the vehicle might sustain whilst it is in her possession.
